Privacy Notice

This notice is issued by Halime Şeyda Horasanlı, MA, psychological counsellor, acting in the capacity of data controller, pursuant to Article 10 of the Turkish Personal Data Protection Law (Law No. 6698, the “Law”), in order to inform data subjects as to how personal data is processed through this website.

Identity of the data controller

The data controller under the Law is Halime Şeyda Horasanlı, MA, psychological counsellor, who may be contacted at merhaba@seydahorasanli.com.

Personal data processed

Personal data is processed on this website only where the contact form is completed and submitted by the data subject. The personal data processed in this context is set out below:

  • Identity data: name (or a pseudonym, should the data subject so prefer)
  • Contact data: email address
  • The message content submitted as free text in the contact form

Purposes of processing

Personal data is processed solely for the purpose of responding to the message submitted by the data subject and conducting the resulting correspondence. Such data is not processed for marketing, profiling, automated decision-making or analytics purposes.

Legal basis for processing

Personal data is processed on the basis of explicit consent, as provided for in Article 5(1) of the Law. Explicit consent is obtained by the ticking of the relevant checkbox at the time the contact form is submitted.

The giving of explicit consent is not obligatory. Where explicit consent is not given the contact form cannot be submitted, and the data subject may contact the data controller directly by email.

Method of collection

Personal data is collected only by means of the contact form on this website, by automated means in electronic form, upon submission of the form by the data subject. Personal data is not collected by any other means.

Retention period

Personal data submitted by means of the contact form is not recorded in this website's database. The message is delivered directly to the data controller by email and is retained solely within the data controller's email account. The data subject may request the erasure of such data following the conclusion of the correspondence, in accordance with the application procedure set out below.

Transfer of personal data abroad

Two service providers are engaged in order that the message may be delivered to the data controller, and personal data is accordingly processed via servers located outside Türkiye:

  • Vercel — the platform on which this website is hosted. Its servers are located in Frankfurt, Germany.
  • Resend — the service provider by which the contact form content is converted into an email and transmitted. Mail is sent from Ireland; however, Resend stores sending logs and email metadata in the United States irrespective of the region selected.

Records relating to the message are therefore processed in the United States. Neither the United States nor the European Union has been declared a jurisdiction affording adequate protection by the Personal Data Protection Board. The legal basis for the transfer is explicit consent obtained under Article 9 of the Law. The ticking of the consent box constitutes consent to this transfer abroad. Where the data subject does not wish to give such consent, an email may be sent directly to merhaba@seydahorasanli.com without use of the contact form.

Cookies

No analytics, advertising or tracking cookies are used on this website. Only the following two technical records are kept, for the purpose of ensuring the functionality of the site:

  • NEXT_LOCALE — stores the language preference selected by the data subject.
  • A record held in the browser's local storage indicating that the cookie notice has been dismissed.

Neither record identifies the data subject, and neither is shared with third parties.

Rights of the data subject

Pursuant to Article 11 of the Law, the data subject has the right, upon application to the data controller, to:

  • Learn whether personal data concerning them is being processed
  • Request information in respect of such processing, where personal data has been processed
  • Learn the purpose of the processing and whether the data is used in accordance with that purpose
  • Know the third parties within or outside Türkiye to whom personal data has been transferred
  • Request rectification where personal data has been processed incompletely or inaccurately
  • Request the erasure or destruction of personal data within the conditions set out in Article 7 of the Law
  • Request that any rectification, erasure or destruction be notified to third parties to whom the personal data has been transferred
  • Object to any outcome adverse to the data subject arising from the analysis of the processed data exclusively by automated means
  • Claim compensation for damage suffered as a result of the unlawful processing of personal data

Application procedure

The data subject may submit requests concerning the rights listed in Article 11 of the Law to merhaba@seydahorasanli.com, in accordance with the procedure prescribed by the Communiqué on the Procedures and Principles of Application to the Data Controller. The application must clearly state the applicant's name, surname, email address and the subject matter of the request.

Requests are concluded within thirty days at the latest from the date on which the application reaches the data controller. Where the application is rejected, the response given is found insufficient, or no response is given within the prescribed period, the data subject retains the right to lodge a complaint with the Personal Data Protection Board.
